These Terms of Service ("Terms") govern your access to and use of iowaradonexperts.com (the "Site"), operated by Iowa Radon Experts ("we," "us," "our"). By using the Site or submitting a request, you agree to these Terms. If you do not agree, do not use the Site.
1. Nature of Our Service
Iowa Radon Experts is an advertising and lead-referral service. Iowa Radon Experts is a lead-routing service that connects Iowa homeowners with NRPP-certified, IDPH-registered radon mitigation specialists. All radon testing and mitigation work is performed by certified partner contractors under their own licensing and insurance. We are not a radon mitigation contractor, do not perform field work, and are not a party to any agreement you enter into with a Partner Contractor.
2. No Warranty
The Site and all information on it are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. We make no warranty regarding any work performed by any Partner Contractor; any such warranty is offered solely by the contractor performing the work.
3. Your Responsibilities
- Provide accurate information when submitting a request.
- Independently verify a Partner Contractor's licensing, certifications, insurance, permits, and suitability before authorizing any work.
- Enter into your own agreement directly with the Partner Contractor.
- Use the Site only for lawful purposes.
4. Communications
By submitting a form or calling a number on the Site, you consent to be contacted by us and the matched Partner Contractor by phone, text, and email, including by automated means, as described in our Privacy Policy. Consent is not a condition of purchase. Message and data rates may apply.
5. Intellectual Property
All content, branding, design, and code on the Site are owned by Iowa Radon Experts or its licensors and are protected by law. You may not copy, reproduce, or republish Site content without our written permission.
6. Limitation of Liability
To the fullest extent permitted by law, Iowa Radon Experts and its owners, officers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of services performed by any Partner Contractor, your use of the Site, or your reliance on any information on it. Our total aggregate liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100). Your sole remedy for any dispute concerning work performed is against the Partner Contractor that performed it.
7. Indemnification
You agree to indemnify and hold harmless Iowa Radon Experts from any claim, loss, or expense arising out of your use of the Site, your violation of these Terms, or your dealings with any Partner Contractor.
8. Governing Law
These Terms are governed by the laws of the State of Iowa, without regard to conflict-of-laws principles. [Governing-law and venue/arbitration terms to be confirmed by counsel.]
9. Changes
We may modify these Terms at any time. Changes are effective when posted with an updated "Last updated" date. Continued use of the Site constitutes acceptance.
